Chapter 13 Client Tools & Information

1.   After your hearing takes place, you should NOT contact your Trustee for any reason! We will communicate with the Trustee if any issues come up.

2.   The Trustee’s role is to basically act as your accountant and manage your payments to your creditors for a set period of time. After that time is up, your creditors will be viewed as paid in full.

3.   When and how to make your payment to the Trustee…Your 1st payment is due 30 days after your case is filed and is due every month.  You can find the date of your filing on the Notice you received from the court at the top right-hand side of the 1st page. Your Trustee’s name is listed under #5 at the bottom of the 1st page. You will either have John Hauber or Ann DeLaney. There are 3 ways you can make your payment:

 

  • Mail your payment: In the memo section of your check, write your case number and the last 4 digits of your social security number.

  • Wage Assignment: This is where we set it up so that a certain amount will be deducted from your paycheck and sent to the Trustee automatically. We always recommend you glance at each paycheck to confirm the money has been removed from your check.


4.   In some cases, your Trustee may ask to see your tax returns every year you are in your Chapter 13 plan. This is so they can confirm that you are income has not increased significantly while you are in your plan. If this is the case, you will email or drop off a copy of your returns to our office for us to forward to your Trustee.
